Goldspar Australia Pty Ltd warrants that products manufactured by Goldspar are free from defects in material and workmanship under normal conditions of use and service.
Any claimed defects are to be reported in writing to Goldspar’s Head Office within one year of shipment of the product. Upon examination, products found to be defective will be replaced free of charge or, at our option, an applicable credit given.
Goldspar is responsible for the original value and shipment of replacement product but does not accept any consequential damages or costs related to any claimed defect. No products are to be returned without our prior written approval.
Integral or applied finishes and labour costs for removal and/or reinstallation of original or replacement parts are excluded from this Warranty.
The Warranty excludes damage caused by incorrect installation, overloading, accidents, misuse or neglect.
The Warranty excludes alterations, additions and/or modifications unless specifically advised in writing and approved by Goldspar.
Goldspar will not be responsible where its product has been installed in unacceptable conditions or environments, or where an environment has subsequently changed. This Warranty excludes fatigue damage or failure resulting from induced vibration, vibration caused by air current or any other local condition. This Warranty is applicable to Lighting Standards subject to the Standard being properly attached to a support foundation of adequate design. Whilst Goldspar is prepared to offer general installation advice it does not take responsibility for design, performance or recommendations for foundations or other support structures.
Purchasers may have rights at law which cannot be excluded. Where rights at law may be excluded, those rights are so excluded. Where rights at law may not be excluded but may be limited, those rights are limited to the extent permitted by law.
Where consumer guarantees at law cannot be excluded, products manufactured by Goldspar come with such guarantees as cannot be excluded under the Australian Consumer Law and the Consumer Guarantees Act 1993 (New Zealand). The terms stated above (which are negated to the extent that those terms are inconsistent with non-excludable consumer rights under such guarantees), where such guarantees operate consumers are entitled to a replacement or a refund for a major failure of a Goldspar manufactured product and for compensation for any other reasonably foreseeable loss or damage. Consumers are also entitled to have a Goldspar manufactured product repaired or replaced if the product fails to be of acceptable quality and failure does not amount to a major failure.
Please follow the instructions as to use and report problems promptly: problems caused by use that is abnormal or contrary to instructions will generally not be covered. You should contact your product provider in relation to problems with products and we at Goldspar will assist your product provider to resolve them.
The conditions of this Warranty are applicable to products supplied by Goldspar agents, but no commitment beyond this Limited Warranty is applicable or binding upon Goldspar unless endorsed in writing by Goldspar.
